1. Introduction

Welcome to Social Stories Creator ("Service"). By accessing or using this Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you should discontinue use immediately.

These Terms govern the use of Social Stories Creator and all content, features, and services available (the "Platform").

2. No Liability Disclaimer

No Guarantees: The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
No Responsibility for AI-Generated Content: This Service utilizes AI-generated content (including but not limited to text, images, and stories). We do not guarantee the accuracy, suitability, legality, or reliability of AI-generated content.
No Medical or Legal Advice: The Service does not provide medical, therapeutic, or legal advice. Content generated or provided is for informational purposes only and should not be considered professional advice.
No Liability for Errors or Losses: The owner(s) of this Service shall not be liable for any direct, indirect, incidental, consequential, or special damages resulting from the use of the Service.

3. User Responsibility

Users assume full responsibility for how they interact with and use the Service.
Users must ensure that their generated content does not violate any laws, regulations, or ethical guidelines.
Users must be aware that AI-generated content may contain inaccuracies or unintended biases.

4. Intellectual Property & Content Ownership

AI-Generated Content: All AI-generated content (stories, images, etc.) is provided as-is with no claims of ownership from the Service provider. Users should verify copyright policies before using AI-generated content commercially.
User-Generated Content: Users retain ownership of any manually created content but grant the Service a non-exclusive, worldwide license to store and display such content as necessary to provide the Service.

5. Account & Credit System

No Refund Policy: All purchases of credits or premium features are final and non-refundable.
Credits Have No Monetary Value: Credits used to generate stories and images are a virtual currency within the Service and do not hold real-world monetary value.
Account Termination: The Service reserves the right to suspend or terminate any account violating these Terms, including but not limited to:
- Abusing AI-generated content.
- Engaging in prohibited activities (see Section 6).
- Violating legal or ethical guidelines.

6. Prohibited Use

Users may not use the Service to:

Generate or distribute hateful, defamatory, violent, illegal, or explicit content.
Violate intellectual property laws.
Abuse or exploit AI-generated outputs in a deceptive, misleading, or unethical manner.

7. Privacy & Data Storage

No Guarantees of Data Retention: The Service does not guarantee indefinite storage of user data, stories, or images.
AI Training Disclaimer: AI-generated content may be produced by third-party AI providers (such as OpenAI) whose data policies are separate from ours.
Cloud Storage Disclaimer: Images generated are stored via Cloudinary, and we are not responsible for their availability or removal policies.
Cookies & Tracking: We use cookies to improve the user experience. You can disable cookies in your browser settings.
Content Storage and Retention: We do not guarantee indefinite storage of stories, images, or other content you create with the Service:

Stories and associated media are generally retained for at least twelve (12) months from the last time you open that story while logged into your account.
If a story has not been opened for more than twelve (12) consecutive months, it may be permanently deleted from our systems as part of our data retention and storage management practices.
Before we permanently delete a story for inactivity, we will make reasonable efforts to send reminder emails to the email address associated with your account approximately thirty (30) days, fifteen (15) days, and one (1) day before the scheduled deletion date. These reminders are provided on a best-effort basis and are not guaranteed.
Once content is deleted for any reason, including user request or automatic deletion due to inactivity, it is permanently erased from our systems. Recovery is not possible.

8. Service Availability & Modifications

The Service provider reserves the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

9. Indemnification

By using this Service, you agree to indemnify, defend, and hold harmless the Service provider from any claims, damages, or liabilities arising from:

Your use of AI-generated content.
Any legal consequences of how you use the Service.
Any misuse or violation of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to conflict of law principles.

11. Updates to These Terms

These Terms may be updated at any time. Continued use of the Service after modifications constitutes acceptance of the revised Terms.

At Social Stories Creator, we respect your privacy and are committed to protecting your personal data. This Privacy Policy explains what information we collect, how we use it, and your rights regarding that information.

2. Information We Collect

Email addresses, story prompts, and payment details (processed securely via Stripe).
Log data, including browser type, IP address, and timestamps.
Cookies for session management and user experience improvement.
Data on how users interact with our site. This may include user behavior patterns and aggregated demographic information, which help us improve user experience and service effectiveness.

3. How We Use Your Information

Provide and improve our AI-generated content service.
Process payments and manage virtual credits.
Monitor and prevent abuse or misuse of the Service.

4. AI Processing

Generated stories and images are created using third-party AI providers, including OpenAI. We do not control AI processing and do not retain AI inputs beyond the session scope.

5. Data Retention

We retain your stories and associated images as long as your account is active and for at least twelve (12) months from the last time you open a given story while logged into your account. After twelve (12) consecutive months of inactivity for a story, that story and its associated media may be permanently deleted from our systems, in accordance with our Terms of Service and data hygiene practices.

6. Analytics and Data Collection

We use Google Analytics and Microsoft Clarity to enhance our service and better understand how our users interact with our website. These tools collect information such as how you navigate and use features of our site. This data is processed under the privacy terms of Google and Microsoft, respectively. For more detailed information on how these platforms manage your data, please refer to their individual privacy statements. By using our website, you consent to the collection and use of this information by us and our analytics partners.

7. User Rights & Account Deletion

Users have the right to request data deletion by contacting us using our contact form. Deletion requests will be honored unless retention is legally required.

8. Children's Privacy

The Service is not intended for children under 13. If a user under 13 is identified, their account will be deleted.
